The ruling against Trump on the AEA is cause for hope, but not celebration

Yesterday was May Day, historically a day when labor unions celebrate the work of those who have come before and advocate for labor reforms yet to come. This year, in light of the last four months, the traditional May Day celebrations doubled as a protest of Donald Trump, the most labor-hostile president in recent history.

You may not have seen much about the protests on cable or local news, but this is what downtown Chicago, the birthplace of the 8-hour workday, looked like yesterday:

I love this shot because you can see how many people are part of this march — that is at least five city blocks worth of people. This was happening across America and around the world. I love my union, and I hope you’re lucky enough to be in a union, too.

But let’s get to the big news from yesterday: A federal district court has ruled that Donald Trump can not use the Alien Enemies Act as his premise for removing people from the country without due process.

US District Court Judge Fernando Rodriguez Jr., a Trump appointee, did what no other judge has done (so far) and ruled that Trump can not use the 227-year-old Alien Enemies Act as a basis to remove undocumented immigrants.

This was always a no-brainer, considering that, as contemplated in the AEA, the US is neither at war with Venezuela nor whatever gang the administration is accusing people of belonging to at the time. The problem, as always, was all the cloying, slavering Trump adherents who pretended the White House’s take was a legitimate interpretation of the law. It was not. As I keep saying, our parents and teachers told us the story of the Emperor having no clothes for a reason.
